Part 1 : The Freedom of Information Act 2000
The Freedom of Information Act 2000 received Royal Assent on 30 November 2000 and came into force across the UK on 1 January 2005. It gives a general right of access to all types of recorded information held by public authorities, sets out exemptions from that right and places a number of obligations on public authorities.
A "public authority" is defined in the Act, and includes, but is not restricted to, central and local government, non-departmental public bodies, the police, the health service and schools, colleges and universities.
Any person who makes a request in writing to a public authority for information must be (a) informed whether the public authority holds that information and (b) subject to exemptions, supplied with that information within 20 days of receipt of the request.
Individuals have a separate right of access to information about themselves under the Data Protection Act 1998.
Every public authority is required to adopt and maintain a publication scheme setting out the classes of information it holds, the manner in which it intends to publish the information, and whether a charge will be made for the information. This is to ensure a significant amount of information is available without the need for a specific request being made. Schemes are intended to encourage organisations to publish more information pro-actively and to develop a greater culture of openness.

The Information Commissioner is responsible for enforcing the Freedom of Information Act and:
- Promotes good practice
- Approves and assists in the preparation of publication schemes
- Provides information about the public's rights under the Act
- Enforces compliance with the Act
Part 2: The Revenue and Customs Prosecutions Office (RCPO)
The Commissioners of Revenue and Customs Act 2005 established the RCPO as a government department. Its role is to prosecute all criminal cases investigated by HM Revenue and Customs (HMRC) and recover the proceeds of crime in respect of those cases. The RCPO is part of the UK's Criminal Justice System (CJS), and is affected by changes and developments in that system. It is one of the Law Officer's Departments and is accountable to the Attorney General.
Part 3: The Purpose of this Publication Scheme
The purpose of this publication scheme is to set out:
- What information the RCPO publishes or intends to publish as a matter of course;
- How this information will be published;
- Whether the information will be available free of charge or on payment.

The RCPO publication scheme covers its commitments under the Freedom of Information Act. Responsibility for ensuring RCPO complies with its obligations under these Acts lies with the Director of RCPO . The RCPO Chief Operating Officer is responsible for the overall maintenance of the publication scheme. The Information Officer is responsible for operating the scheme. The publication scheme will be reviewed at least annually, according to the requirements of the Information Commissioner’s Office.
Part 4: The RCPO Information Policy
Subject to legal exemptions, the RCPO's information policy is to publish as much information as possible on subjects of public interest.
Wherever possible, the information will be published on the RCPO internet site, but will also be available in paper form. However, exemptions may prevent some information from being released.
Generally information included in the publication scheme will be provided free of charge, but a charge may be made if the cost of provision exceeds £25; this may include large amounts of photocopying or postage. You will be advised of any charge, which must be paid before the request is actioned.
Part 5: Obtaining information on the RCPO
The RCPO was created in April 2005 by the bringing together of the criminal prosecutions and asset recovery teams of Customs and Excise and Inland Revenue. Historic information can be found within documents published by Her Majesty's Revenue and Customs (HMRC) at www.hmrc.gov.uk.
It is our intention to publish the RCPO's Annual Reports and Accounts and other information as it becomes available on our internet site. Initially many of our policies have been the same as those of HMRC. Details can be found at www.hmrc.gov.uk, or copies can be obtained from RCPO. As we develop our own policies these will be published on our internet.

Part 6: Appeals, Complaints and Feedback
The RCPO will endeavour to meet your request, but there will be some information that it will not be able to provide. Such information will come within one of the exemptions under the Freedom of Information Act 2000. The RCPO will let you know if it considers that an exemption applies. You will also be informed on how you can appeal against a refusal.
If you are unhappy with the decision made in relation to your request, you may ask for an internal review. You should contact Helen Wolkind, 2nd Floor, New King’s Beam House, London SE1 9BT, if you wish to complain.

The supply of information under the Freedom of Information Act does not give the person or organisation who receives it the right to reuse it in a way that would infringe copyright, for example, by making multiple copies, publishing and issuing copies to the public. Brief extracts may be reproduced under the fair dealing provisions of the Copyright, Designs and Patents Act 1988 (sections 29 and 30) for the purposes of research, private study, criticism, review and news reporting.

Class 1 Our Organisation

Format and Charges
Material available through the RCPO Publication scheme will be provided either electronically or on paper. Applicants should specify their preferred delivery method when submitting a request.
Published material accessed on the RCPO internet site will be available free of charge (although you may have to pay for internet access). Other enquiries may incur a charge if the cost of provision exceeds £25. You will be advised of any charge, which must be paid before the request is actioned.
